1. Ordering via the fenix-agricultural.com ordering system – you can put the selected product or products in the cart and, upon completion, select the delivery method and payment method, and fill in your information. After placing a correct order, you will receive an order confirmation via email. If you have not received an order confirmation, please check that you have entered the correct email address or contact us.
2. Ordering by phone or email - you can order the selected products in direct contact by phone +385 21 317 313 during store working hours or by e-mail: prodaja@fenix-agricultural.com from 0-24 hours.
3. Shipping costs 10 EUR for Croatia.
All orders are subject to the General Terms and Conditions/Terms of Use as set out below.
General terms and conditions/terms of use
Meaning of terms used in these general terms and conditions
1. Seller – the company Sjeme doo Ul. Bilice II 21E, 21000 Split, registered with the Commercial Court in Split under the entity registration number (MBS) 060081450, MB: 01085620, OIB: 52650953128, share capital 12,054,500.00 kn paid in full, members of the management board Ana Kuvačić, Ranko Kuvačić, Jure Kuvačić, which carries out the activity of selling goods and services under the hereinafter referred to as "Sjeme doo".
2. fenix-agricultural.com – websites owned by the Seller
3. Bather – any person who, after reviewing and selecting a product or service, has registered their data and ordered a product or service. In accordance with the Consumer Protection Act, a contract on behalf of and for the account of a minor or a person with complete legal capacity may only be concluded by their legal representatives. Persons with partial legal capacity may only conclude a contract with the consent of their legal representative.
4. User – any person who uses the website "fenix-agricultural.com" for the purpose of obtaining information about a particular product or other published data
5. Use "fenix-agricultural.com" – access to the fenix-agricultural.com website to obtain information about its content
6. Order – the process of ordering products or services via the ordering system on the website "fenix-agricultural.com"
7. Products and services – all products and services that are featured on "fenix-agricultural.com", and which can be ordered through the ordering system on fenix-agricultural.com.
General provisions of the terms of sale 1. The holder of all rights to the website “fenix-agricultural.com” is the company Sjeme doo Ul. Bilice II 21E, 21000 Split, OIB: 52650953128 (hereinafter referred to as Sjeme) 2. By using the service of ordering products/or services on the website “fenix-agricultural.com” as well as all associated pages and services on “fenix-agricultural.com”, it is understood that the Customers are at all times familiar with these Terms of Sale (hereinafter referred to as: Terms), and that they fully understand and accept them.
2. These Terms apply to the rights and obligations relating to ordering products or services through the ordering system on “fenix-agricultural.com” and the rights and obligations arising from the conclusion of a Distance Selling Agreement (hereinafter referred to as the Agreement) between the consumer as the end customer and the company Sjeme. All information on or obtained from the “fenix-agricultural.com” website is considered an integral part of such agreements. and in relation to the conditions and method of ordering products, prices of products and services, payment methods, warranties, complaints and returns, delivery, unilateral termination of the contract within 14 days, protection of personal data confidentiality and other issues related to the use of “fenix-agricultural.com” and the process of online ordering of goods and services.
3. We advise users to familiarize themselves with these Terms and Conditions before making a purchase and to check them regularly, in order to be aware of all rights and obligations.
4. The contract for the purchase and sale of products between the Buyer and the Seller is concluded at the moment of ordering the products, regardless of how the products are ordered (via the ordering system, by telephone, e-mail or some other means).
5. Through "fenix-agricultural.com" it is possible to place an order for products in the Republic of Croatia as well as in other countries. The order also includes an order for delivery of purchased/ordered products.
6. The Buyer may only be an adult and legally capable person. A contract on behalf of and for the account of minors and persons with complete legal capacity may be concluded by their legal representatives or guardians, and persons with partial legal capacity may conclude a contract only with the consent of their legal representative or guardian. The Seller shall not be liable for any action contrary to this provision.
7. Users of "fenix-agricultural.com" are obliged to provide accurate, valid and complete personal data when filling out the registration form, and failure to do so authorizes the Seller to deny such a user access to or the provision of all or part of the services offered by "fenix-agricultural.com".
8. The Seller is authorized, without prior notice, to change the content of these General Terms and Conditions, the range of products, their prices, other information related to the products and services presented here, as well as all other content on "fenix-agricultural.com", which is why Users are obliged to review the content of the website each time they visit it. Failure to do so releases the Seller from any liability. The aforementioned changes shall enter into force upon publication on the "fenix-agricultural.com" website.
9. The Seller is exempt from any liability for damage that may occur to devices that enable access to “fenix-agricultural.com” and data stored on the same devices when using “fenix-agricultural.com” if it is caused by illegal actions of third parties, computer viruses, etc., and other cases for which the Seller is not responsible. Also, the Seller is exempt from any liability in the event of circumstances that prevent the use of “fenix-agricultural.com”.
10. Sjeme reserves the right to make errors in the description and image of the product that are placed according to the information provided by the manufacturer. Sjeme places all materials, photos and text on the website in good faith to make it easier for the customer to make a purchase. Sjeme cannot guarantee with 100% certainty that the product photos fully correspond to the appearance of the product itself. We are not responsible for possible unintentional errors in the product description, please inform us if you notice them. In some exceptional cases, different appearances of the actual product and the product photos and/or the described product on these pages are possible, if the manufacturer changes any of the characteristics or content of the product. All descriptions are regularly and thoroughly checked and any errors are removed and/or corrected Ordering products – concluding a sales contract 1. Ordering products can be done by phone, email or if the buyer registers at the designated place on "fenix-agricultural.com". When filling out the registration form, the buyer is obliged to provide accurate, valid and complete personal data. These Terms and Conditions, as well as individual terms of sale indicated with information about certain products, represent an offer by Sjema for concluding a Contract, and the user, as the buyer, accepts them by registering, concluding an order or in another manner determined by these Terms, which is considered to be a contract concluded between the buyer and Sjema, according to the terms of sale specified in these Terms.
2. The subject and commercial purpose of the Agreement is the purchase of a selected product or service through "fenix-agricultural.com" with the payment of an appropriate fee - the price of that product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: internet order, printed promotional messages with purchase order, telephone with human mediation or e-mail.
3. The Buyer is authorized to choose the option for the Seller to inform him/her about new products, products on sale, etc. (newsletter). After successful registration (all required data correctly filled in), a notification of successful registration will be delivered to the Buyer's e-mail.
4. The products that can be purchased are advertised on "fenix-agricultural.com" and information on the product specification and price is provided with each product. All prices on "fenix-agricultural.com" are expressed in EUR and include VAT 25%. The price and terms of delivery are listed under "Product Delivery".
5. The selection of the desired product is done by saving it in the "basket" by clicking on the "Add" link. If the Buyer places an order for a product that has, in the meantime, been sold out, then the Seller will contact the Buyer to agree on further action, which may include a refund of the amount paid, the purchase of another product or the delivery of a product of the same type when the Seller obtains it from its suppliers. The Seller, apart from the obligation just mentioned, cannot be held liable to the Buyer in the described case on any basis.
6. The "basket" contains all the products that the Buyer has selected for purchase, along with the product price, which includes VAT 25%, as well as the delivery price (if the free delivery option is not selected). If the Buyer wishes to continue shopping, he selects the "Continue" link, and the system automatically takes him to a page where he needs to confirm the data provided by the Buyer during registration, the delivery address, confirm or possibly change the delivery of the invoice and select the payment method (advance payment or payment on delivery). After selecting all the necessary parameters, the order is completed with the "Complete order" link
7. After completing the above steps, the Buyer will receive an order confirmation via email. 8. Upon receipt of the order, Sjeme processes the order and determines the validity of the order and may, if necessary, contact the Buyer for additional checks of the ordered items as well as the Buyer's legal capacity. Sjeme may independently cancel the order without further liability if it determines that the Buyer does not have a legal basis for the purchase or if the Buyer has filled in false information in the order, or for some other reasons not listed here that prevent normal delivery or business relationship between Sjeme and the Buyer. In this case, the order receives the status of CANCELLED order and as such is no longer considered for delivery/processing. 9. When processing the order, regardless of the method of ordering (telephone, email, registration form or similar), Sjeme will deliver the order based on the availability of the ordered items. If the order does not have 50% or more ordered items, the order will not be processed and the Buyer will be notified. In all other cases, Sjeme will deliver all items ordered by the buyer that Sjeme has in stock/warehouse. 10. Upon arrival of items that were not processed/included in the order or delivery, Sjeme will notify the buyer of their arrival in stock before shipping to the buyer. The buyer may then opt out of receiving such items without further costs to him. 11. Before delivery, Sjeme checks all ordered products and determines their correctness. If a product proves to be defective, Sjeme will notify the buyer and arrange another delivery date depending on whether the ordered product is available or not. If such a product (including the characteristics and/or price of the product) is no longer available or the buyer opts out of subsequent delivery, the order is canceled without any further costs to the buyer and Sjeme's obligations to the buyer. 12. If the buyer refuses to receive the products he ordered without first canceling them, Sjeme will initiate legal action in order to collect the actual costs of transporting the package to the buyer and from the buyer to Sjeme. All documents created during the ordering process are considered confirmation of prior notification in accordance with Art. 43 of the Consumer Protection Act (Official Gazette, No. 41/2014). 13. Sjeme is liable for material defects in the products in accordance with the Obligations Act. REFUSAL OF SENDING AN ORDER BY THE SEED COMPANY
The company Sjeme reserves the right to refuse an order at any time if it determines that:
– the person who placed the order is not a real person or is a person who does not have the legal capacity to purchase
– The buyer provided an incomplete address and/or phone number (e.g. missing house number, non-existent address, phone number, or similar)
– The customer does not answer the call or does not respond to the email from the company Sjeme
– The customer had previously ordered the products but the customer refused to accept the package that arrived
– other cases in which it is clear that it is not possible to establish a business relationship
When rejecting an order, Sjeme keeps a separate internal record within the rejected order about the reason for the rejection. The customer can contact Sjeme at any time and get the actual reason for the rejection of their order.
Price 1. Prices of products and services are retail. Product prices and delivery prices on our website are expressed in euros ( € ) and in kunas (HRK) until the end of 2023 and include value added tax (VAT) 25%. The seller updates the displayed prices on a daily basis, which is why there is a possibility that the prices in the retail store at the location Sjeme doo Bilice II. 21E, 21000, SPLIT may be different from the prices on "fenix-agricultural.com", but all listed prices are valid for purchases via the ordering system, regardless of a possible different price for the same product in the store.
2. The Seller is authorized to change prices without prior notice, as it is authorized to change prices without prior notice exclusively for products and services listed on “fenix-agricultural.com”. Also, the Seller is authorized to determine discounts, daily or weekly promotions, promotions for a single product, group of products and/or for all products at any time without prior notice. The aforementioned benefits may be exclusively for ordering through the “fenix-agricultural.com” ordering system, which will be indicated to the buyer before ordering.
3. All ordered goods will be delivered at the prices that were valid when the offer/order confirmation was made. Products on sale – sale 1. In a special section on the fenix-agricultural.com website, there is a small number of products that are sold at a lower (promotional price). Link to such products https://fenix-agricultural.com/proizvodi-na-akciji/. Within that menu there are products that are currently on sale or a special promotional campaign that can last until the items are sold out or until the stock for the product that is on sale runs out. All products are new, unused and fully functional. 2. Sjeme d.o.o. independently or in agreement with suppliers decides on the filling of items in the "Action" sub-menus. The same delivery and warranty conditions apply to all products in the listed submenus as for all other products on fenix-agricultural.com. 3. All products that are in the submenus "Action" are mirrored (duplicated) in the product categories whose types are the listed products. For example if there is a specific product in the "Offer" category that is actually a "carriola", the same duplicate product will be found in the "Carrioles" menu in the "Carrioles" submenu with the same markings that inform the customer that it is a product with a special price due to the above reasons. 4. All products in the ACTION section (submenu) can be purchased by all customers under the same conditions as other products. 5. The free delivery provision does not apply to the listed products.
Pre-contractual notification and confirmation of prior notification, confirmation of the concluded Contract
Pre-contractual notice pursuant to Article 57 of the Consumer Protection Act (Official Gazette, No. 41/2014) is an email that the buyer receives to their email address together with the order confirmation in accordance with these Terms and Conditions and a separate PDF document titled PRE-CONTRACTUAL NOTICE.PDF
The buyer will receive a confirmation of the concluded Contract in accordance with Article 69 of the Consumer Protection Act (Official Gazette, No. 41/2014) together with the invoice for the purchased goods.
Payment 1. The buyer can pay for the ordered products via bank transfer (internet banking, post office, FINA) or cash on delivery. 2. Payment is considered made at the moment of receipt of funds to the Seller's transaction account opened with Privredna banka Zagreb dd, Zagreb, IBAN: HR6523400091110355440. Delivery of products to your address and handling of complaints related to delivery 1. Delivery is possible at a price of 10 EUR + VAT throughout Croatia, except for products over 20kg. 2. All packages that arrive at your address via delivery services (HP, GLS, etc.) are insured up to the total amount you paid for the ordered goods. 3. Sjeme doo is not responsible for the delivery process itself, as this is exclusively the responsibility of the delivery services. If during the delivery process to your address, the products that are the subject of delivery are broken or stolen, please contact the delivery service that delivered the ordered products immediately without delay, ask for the complaints department and initiate the complaint procedure. When receiving a resolution to the complaint from the delivery service, deliver it to our address together with the broken products at your expense, and we will, in agreement with you, send the missing parts or entire products to your address at our expense. 4. Without a resolution to the complaint related to transport or damage caused by transport by the delivery services, or if you have not sent the broken products to our address, Sjeme doo cannot send replacement or new parts to your address. Warranty for purchased products 1. All mechanical or electronic products displayed on “fenix-agricultural.com” have a minimum one-year warranty, and depending on the manufacturer and type of product, the warranty may be up to 24 months from the date of purchase. 2. When purchasing a mechanical product (fishing reels, scales, indicators), Sjema will issue the buyer a Warranty Certificate (where applicable) with clearly stated Warranty conditions and warranty period, as well as a fiscalized Invoice for the purchased products. If the mechanical or electronic product is not accompanied by a Warranty Certificate, the buyer will have a Warranty period of 12 months, and the basis for its realization is a fiscalized invoice. 3. The buyer is obliged to keep the invoice and/or warranty certificate throughout the warranty period. The invoice and/or warranty certificate are the only documents with which the buyer can exercise his rights. 4. Repair and/or replacement of defective products from points 2 and 3 of this paragraph is described in detail in the paragraph Service conditions - delivery of products for service and warranty check Service conditions – product delivery for service and warranty verification 1. Tool manufacturers and/or importers guarantee that the product, if used properly and in accordance with the enclosed instructions, will function properly during the warranty period. The manufacturer's service network undertakes to, upon your request submitted during the warranty period, at its own expense, eliminate all defects and technical deficiencies of the product in its (or contracted) service premises, which have arisen during normal use during the warranty period. If the defect is not eliminated within the legally prescribed period after receiving the product for service, the service undertakes to replace the product with a new one (or refund the money), in agreement with the Seller. 2. A product that is broken or generally defective and is covered by the warranty period must be delivered with all its associated parts (whether correct or defective, broken) together with the Invoice and/or Warranty Certificate to the Seller's address: SJEME doo Bilice II. 21E, 21000, SPLIT, Croatia (unless otherwise stated in the special documentation that accompanied the product). 3. Without receiving the product (in its entirety, regardless of its condition) and the documentation referred to in Article 2 of this section, Semen is unable to assess the product defect or check the warranty conditions and, as such, remove it or refer it to the service referred to in paragraph 1 of this article. Termination of contract and return of goods 1. Before concluding the Agreement, the user has the opportunity to review the Terms of Use and Ordering by clicking on them (notice from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), as well as the user's right to unilaterally terminate the Agreement with the form for unilaterally terminating the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.)
2. The User receives a form for unilateral termination of the Agreement along with the invoice. The User can unilaterally terminate the Agreement within 14 (fourteen) days from the delivery of the goods to the customer without giving a reason. To terminate the contract, please contact us at prodaja@fenix-agricultural.com 3. The right to unilaterally terminate the Contract is excluded in the following cases:
- if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
– The right to unilaterally terminate the contract is excluded in the sale of a product made to the consumer's specifications, a product made exclusively for the consumer, or a product which, due to its nature, cannot be returned or is subject to rapid deterioration.
The buyer's right to terminate the contract and deadlines for terminating the contract (excerpt from the Consumer Protection Act), Narodne novine, no. 41/2014:
Right to terminate the contract – Article 45.
(1) Any contract concluded by means of remote communication to which the rules contained in this chapter of the Act apply, the consumer may, without giving a reason, terminate it within 14 days.
(2) In the case of concluding a contract for the sale of a product, the period referred to in paragraph 1 of this article begins to run from the day the consumer received the product, assuming that prior to that the confirmation of the prior notification from Article 44 of this Act was delivered to the consumer.
(3) In the case of concluding a service contract, the period referred to in paragraph 1 of this Article shall begin to run from the date of conclusion of the contract, or, if the consumer has not received a confirmation of prior notification by the time the contract is concluded, from the date of receipt of the confirmation of prior notification.
Deadline for termination of the contract if confirmation of prior notice has not been delivered – Article 46.
(1) If the trader has not provided the consumer with a confirmation of the prior notification referred to in Article 44 of this Act, the consumer shall have the right to terminate the contract within three months.
(2) In the case of concluding a contract for the sale of products, the period referred to in paragraph 1 of this Article shall begin to run from the date of receipt of the product.
(3) In the case of entering into a contract for the provision of services, the term referred to in paragraph 1 of this Article begins to run from the date of entering into the contract.
(4) If the trader, within the period referred to in paragraph 1 of this Article, delivers to the consumer the confirmation of the prior notification referred to in Article 44 of this Act, the consumer has the right to terminate the contract within 14 days from the date of receipt of the confirmation of the prior notification.
Form of contract termination – Article 47.
(1) The contract shall be terminated by written notice of termination sent to the trader.
(2) The contract is terminated at the moment the trader receives the notice of termination.
(3) It is considered that the contract was terminated on time, if the notice of termination was sent within the deadlines from Articles 45 and 46 of this Act.
Consequences of contract termination – Article 48.
(1) In the event of termination of the contract, the consumer is obliged to return the product to the trader at his own expense.
(2) The consumer is not liable for damage suffered by the trader due to termination of the contract.
(3) The trader is obliged, within 30 days from the date of receipt of the written notice of termination, to refund to the consumer the entire amount that the consumer has paid under the contract up to the moment of termination, increased by default interest at the interest rate of the trader's commercial bank for three-month term savings deposits for the entire period, counting from the receipt of the written notice of termination until payment.
Exclusion of the right to terminate the contract – Article 49.
Unless the parties have agreed otherwise, the consumer does not have the right to terminate the contract pursuant to Articles 45 and 46 of this Act if the contract is:
- on the provision of a service, if the provision of the service, with the express consent of the consumer, began before the expiry of the period within which the consumer had the right to request termination of the contract,
- on the sale of products or the provision of services whose price depends on fluctuations in the financial market,
- on the sale of a product made to the consumer's specifications, a product made exclusively for the consumer, or a product which, due to its nature, cannot be returned or is subject to rapid deterioration,
- on the sale of audio or video and computer programs that have been unpacked by the consumer,
- on the sale of newspapers, periodicals and magazines
- about games of chance
Impact of contract termination on the approved loan – Article 50.
If, for the purpose of partial or full payment of the price under a distance contract for the sale of a product or service, the consumer has been granted a loan by the trader or a third party who has granted the loan to the consumer on the basis of his agreement with the trader, the termination of the contract for the sale of the product or service shall also terminate the loan contract.
Consequences of termination of the loan agreement – Article 51.
If the consumer, based on the provisions of Articles 45 to 50 of this Act, terminates the loan agreement, the trader or a third party who granted the loan to him based on an agreement with the trader shall not be entitled to charge the consumer any costs, interest or penalty.
Purchase security All ordered and paid products that you, as a customer, request from Sjeme will be delivered to your address as soon as possible, usually within 24 hours from the moment of your order or payment for the product. All products are packaged in protective packaging with all necessary documents, which may include instructions for the safe use of the product. Inside each package is a fiscalized invoice with the data of the customer who placed the order and/or paid for the products. The protective packaging is marked with a clearly visible Sjeme tape, which makes it easy to determine whether there have been any unwanted manipulations during transport. Sjeme makes maximum efforts to satisfy the customer in all segments of sales and post-sales (provided product service that covers specific guarantees specified in the Warranty Card). We will respond to your complaints/complaints no later than 15 days from the date of receipt of the complaint. Also, in accordance with paragraph 4 of Article 10 of the Consumer Protection Act, the fiscalized invoice that the buyer receives with the purchased products clearly states the information on how to submit a written complaint. The complaint record and the method of resolving the complaint are kept on a permanent medium at the location of Sjeme doo Bilice II. 21E, 21000, SPLIT, Croatia in accordance with the provisions of paragraph 6 of Article 10 of the Consumer Protection Act.
Privacy Statement
Seme undertakes not to misuse personal data from the order form.
Personal data is considered to be all data that determines the identity of the customer (for example, name and surname, e-mail address, residential address, etc.).
Sjema will not provide or disclose the customer's personal data to a third party, except in cases where it is expressly prescribed by law and in cases where it is necessary to fulfill obligations.
All customer data is strictly protected and is only accessible to employees who need the data to perform their jobs. All Sjeme employees and business partners are responsible for respecting the principles of privacy protection.
Sjeme undertakes to protect customers' personal data by collecting only basic customer data that is necessary to fulfill its obligations.
Data that are automatically recorded by accessing the website and are not personal data (types of searchers, number of visits, time spent on the pages, etc.), Sjeme has the right to use exclusively for the purpose of evaluating website visits and improving its content and functionality.
Sjeme informs customers about the use of collected data and regularly gives customers the opportunity to choose how their data is used, including the opportunity to decide whether or not they want their name removed from lists used for marketing purposes.
In the event of a change in any of the personal data (e.g. place of residence, delivery address, etc.) recorded during registration, the customer is obliged to notify Sjeme of the change. In the event of a change that is not notified, Sjeme is not responsible for any shortcomings in the order or delivery of the product.
The above provisions on the protection of personal data apply exclusively to the homepage of the online store Sjeme and to all pages within the specified domain, and not to external pages to which links to the specified domain point and for which Sjeme is not competent or responsible, as well as to pages that the fenix-agricultural.com website does not collect and through which it does not process user data.
Except in the case of an electronic order, Sjeme will not send electronic messages to the customer in other cases unless the customer has expressly consented to this (e.g. newsletter).
On-line resolution of consumer disputes Pursuant to Regulation (EU) No. 524/2013 on online dispute resolution for consumers, which has been in force since 9 January 2016, the Online Dispute Resolution Platform for Consumer Disputes (ODR Platform) has been operational since 15 February 2016. Article 14(1) of the Regulation requires traders established in the European Union who participate in online sales or service contracts and online marketplaces established in the Union to provide an electronic link to the ODR Platform in an easily accessible place on their websites. Since the Regulation is directly applicable in the Member States of the Republic of Croatia, regardless of any delay in the adoption of the relevant implementing legal acts. If you believe that we have in any way violated your consumer rights, even after we have jointly tried to remedy any error that may have occurred, you have the option of Online Dispute Resolution for Consumer Disputes.
